The ability to ship cargo across the country is crucial to the success of the cannabis industry.This presentation reviews some core features of transportation law before reviewing how states have followed or ignored that guidance with respect to shipments of federally lawful hemp moving through their borders.The presentation uses the lessons of state treatment of hemp shipments to forecast how states may treat marijuana shipments moving across their borders if marijuana is eventually made federally lawful. Some statutory language to address that issue are also proposed.
